Begin with the outcome you want
An owner can ask the board to consider a concern without starting a petition. Explain the issue, proposed agenda topic, and useful supporting facts. If a formal process is needed, identify which one applies before collecting signatures. A petition is not itself a board decision or permission to hold an unannounced meeting.
Different requests, different tracks
| Goal | Starting point | What to verify |
|---|---|---|
| Ask the board to address an item | §718.112(2)(c)1 | A petition from 20% of the voting interests triggers the statutory agenda process within 60 days after receipt. |
| Request an owner membership meeting | Bylaws and applicable statutory provisions | Who can call it, signature requirement, stated purpose, notice, and authority to act. Do not copy the board-agenda percentage automatically. |
| Request electronic voting for the next election | §718.128(6) | 25% of voting interests; receipt within 180 days after the last scheduled annual meeting; board meeting within 21 days to adopt the resolution. |
| Remove a director | Recall law and applicable rules | Use the separate recall process and documents; see the recall guide. |
For the board-agenda petition, the board must place the item on the agenda at its next regular meeting or a special meeting within the statutory period. That requires consideration, not a guaranteed favorable decision. [source] [source]
Prepare a clear petition
Example of an agenda request: “We request that the board address the association’s walkway-lighting maintenance plan.” If intended as a statutory petition, have the administrator or counsel verify the complete text, signatures, and eligibility.
A board intake workflow
- Date-stamp and preserve the complete submission.
- Determine which procedure it invokes and calculate the deadline from receipt.
- Verify voting interests and signatures consistently; ask for clarification promptly.
- Arrange the properly noticed meeting or other required response.
- Record the action and advise the contact what happened.
A response should explain the process, not turn the request into a personal dispute. Refer disputed eligibility, deadlines, recall questions, and requests outside association authority to counsel.
