UCO committee service · Fair participation

A willingness to serve
deserves a fair
consideration.

How UCO committee appointments work—and how a member-serving organization can welcome useful expertise, independent thinking, and constructive criticism.

Confirm the appointment framework. Recommend a fair process.

Some owners report that criticism of UCO officers has affected their access to committees. Those reports require facts and a fair opportunity for everyone involved to respond. This page does not establish that such exclusions occurred.

Board Synergy’s view: Committee selection should serve owner-members through relevant skills, availability, sound judgment, and respectful conduct. Disagreement with leadership should not, by itself, disqualify a willing volunteer. Appointment discretion should be supported by clear criteria and a consistent process.

As a governance recommendation, establish clear capacity and selection criteria through the appropriate approval process. Explain decisions to unsuccessful applicants using relevant criteria rather than personal loyalties or vague labels. Confirm the authority for committee size and selection with UCO; this page does not determine the legal limits of appointment discretion.

Questions to confirm under Article IX(A)

Article IX(A) of UCO’s posted 2020 amended bylaws is a starting reference for committee appointments. Ask UCO to confirm the current provision, the authority for the particular committee, any committee-specific qualifications, and applicable adopted selection policies. The questions below organize that inquiry rather than determine an applicant’s eligibility or entitlement:

  1. President and Officers Committee: What authority does Article IX(A) give the President to create committees or appoint chairs, what Officers Committee advice and consent is needed, and which exceptions apply to this committee?
  2. Committee chair and Officers Committee: Who selects this committee’s members, and what role does the Officers Committee have in advising or consenting under the current provision?
  3. Additional appointment authority: Does Article IX(A) provide a separate presidential appointment route for this committee? Ask UCO to confirm the required advice and consent, exceptions, and any LCAM participation or voting limits.
  4. Assembly-created committees: If the Assembly created the committee, what resolution and bylaw provisions establish its appointment or election procedure, qualifications and approval requirements?

Which membership and appointment conditions apply? Ask UCO to identify the relevant Article IX(A) language, any committee-specific qualifications, the authorized selector and any applicable adopted policy. This guide does not determine whether a particular member is eligible, entitled to appointment, or entitled to reconsideration. Leave any conclusion about a rejected applicant’s legal entitlement or available remedy to independent counsel.

UCO’s committee page invites interested owners to contact a UCO officer at 561-683-9189. Ask which committee has a need and what its current selection process requires.

How an owner can apply constructively

  1. Identify a useful match. Ask about the committee’s mission, current priorities, vacancies, expected meeting attendance, and specific qualifications.
  2. Put your interest in writing. Briefly describe your ownership/member status, skills, experience, availability, and how you would contribute. Ask that it reach the chair and the appropriate approval body.
  3. Ask how the decision will be made. Request the criteria, next review date, and how you will be notified. Confirm whether a general volunteer form also covers this committee application.
  4. Keep the conversation focused on service. Explain that you can work respectfully with people whose views differ. Disclose relevant business or personal conflicts.
  5. Request an answer and next steps. If not selected, ask whether the issue is eligibility, capacity, a skills need, availability, a conflict, or specific conduct—and whether another role or future opening would be suitable.
Recommended practice · Not adopted UCO policy

A fair selection process should make these distinctions.

Relevant qualifications

Subject knowledge, ability to review documents, time to contribute, reliability, and needed experience are sensible criteria. Publish them before evaluating applicants.

Constructive criticism

Questioning a contract, opposing a proposal, asking for records, or supporting another candidate does not alone establish inability to serve. Evaluate how a person works, not whether they always agree.

Documented conduct

Threats, repeated serious disruption, misuse of confidential information, or refusal to follow lawful committee procedures can be relevant. Identify incidents and give the applicant an opportunity to respond. An allegation is not an established fact.

Conflicts and capacity

Conflicts of interest, committee size, overlapping expertise, and scheduling can justify a different selection. Consider disclosure, recusal, training, another assignment, or a waiting list where appropriate.

“Not a team player” is too vague to be a useful explanation unless tied to specific behavior. A person can challenge an idea and still be an effective colleague.

If an owner believes criticism caused rejection

  1. Ask rather than assume. Request a concise explanation of the selection criteria and reason. Keep correspondence and distinguish direct statements from inference.
  2. Offer a factual response. Correct misunderstandings and address specific conduct concerns. Ask how similar applicants are evaluated; protect other applicants’ privacy.
  3. Request review under a clear policy. Ask the chair and Officers Committee how reconsideration works. A different reviewer or recusal may help when an officer has a personal dispute with the applicant.
  4. Involve your association’s delegate. Ask the delegate to raise a selection-policy issue through an appropriate UCO agenda or proposal process rather than relying on personal confrontation.
  5. Seek advice for a specific legal issue. If an applicant disputes the stated criteria, authority or reason for rejection, provide the relevant documents and facts to independent counsel. Counsel should assess any claimed entitlement, governing-document issue, unlawful basis or available remedy; this page makes no finding for an individual applicant.

The reconsideration suggestions here are recommended practices, not a finding that an appeal procedure exists or is legally required. Ask UCO to identify any current adopted review policy and its authority. Have independent counsel address disputed appeal rights or remedies.

What UCO could adopt to build confidence

Ask UCO which safeguards could be adopted by policy, who would approve them, and whether any proposal would require a bylaw amendment or other authorization. Have counsel review disputed authority or proposed changes to appointment powers.

A sample expression of interest

“I am a Century Village unit owner interested in serving on the [committee]. My relevant experience includes [skills], and I am available [schedule]. I would like to contribute to [specific committee objective].

I recognize that committee members may disagree and am committed to respectful discussion, appropriate confidentiality, conflict disclosure, and the committee’s authorized procedures. Please advise whether there is an opening, what criteria apply, who reviews applications, and when I may expect an update.”

Broad participation strengthens a member-serving organization.

A committee made up entirely of people who share the same assumptions may overlook useful questions. A committee without workable conduct expectations may struggle to finish its work. Fair selection seeks both diverse perspectives and an ability to collaborate.

UCO can protect that balance by explaining its decisions and making room for qualified members who respectfully challenge the prevailing view. Owners can support it by applying in good faith, respecting the process, and proposing specific improvements when the process is unclear.
