Postmarks matter

When a deadline depends on mailing, a date on an envelope may tell only part of the story. Give important association correspondence a reliable paper trail.

A small date can have a big consequence

Association notices, election materials, collection correspondence, and other communications can carry time limits. If the mailing date becomes disputed, the association needs more than someone’s memory that the letters went out on time.

Do not assume the postmark equals the day you put a letter in the mailbox. A processing-facility postmark can be later than the date USPS first accepted the mailpiece.

Clear communication. Reliable records. Confident boards.

What changed recently?

USPS added Domestic Mail Manual §608.11, “Postmarks and Postal Possession,” effective December 24, 2025. USPS describes the addition as a clarification—not a change in its existing postmarking practices.

At a processing facility, the postmark generally reflects the first automated processing operation. That can occur after the day a letter was deposited. USPS also explains how to obtain evidence of acceptance and a local postmark.

The practical lesson is to choose evidence deliberately for deadline-sensitive mail, rather than relying on a later cancellation mark.

Four dates that should not be confused

DateWhat it tells you
Letter or label dateWhen the document or postage label was dated. It does not establish that USPS accepted it then.
USPS acceptance dateWhen USPS took possession, supported by appropriate postal evidence.
Processing-facility postmarkWhen the applicable processing operation occurred; it may be later than acceptance.
Delivery or receipt dateWhen the item reached the recipient or was received under the applicable rule. Mailing evidence alone does not prove this date.
First identify the legal deadline. Does the rule require mailing, delivery, receipt, posting, or several steps? A timely postmark does not satisfy a receipt deadline by itself.

For example, a letter deposited Monday could receive a Tuesday processing postmark. That does not automatically decide whether a Monday mailing requirement was met. The governing requirement and evidence of actual mailing must be examined.

Why this matters to Century Village boards

A mailing dispute can create avoidable questions about whether owners had proper notice or whether an association followed the required process. A board or property manager should know which communications require formal notice and how compliance will be documented.

Florida Statutes §718.112 includes affidavit requirements for specified notices, including certain board-meeting notices and budget transmittal. The exact notice, timing, posting, and delivery requirements vary by event; not every association letter uses the same procedure.

An envelope postmark, postal receipt, and association affidavit serve different purposes. Keep any legally required affidavit even when you also obtain postal evidence. Optional evidence does not replace a mandatory method or required document.

Choose the evidence that fits the mailing

OptionBenefit and limit
Manual local postmarkRequest a manual postmark at a staffed USPS retail counter when tendering the mail. Preserve an image if practical; the envelope goes to the recipient. It does not prove delivery or contents.
Certificate of MailingProvides a dated record that mail was presented to USPS. Keep the validated certificate. It does not provide a delivery record or insurance.
Certified MailProvides a mailing receipt and delivery/attempt information. Obtain documented postal acceptance; purchase Return Receipt when appropriate. A tracking number or label alone is not proof of acceptance.
Association affidavitRecords the responsible person’s sworn account of the actual notice process. Use it when required and consider it as additional evidence where appropriate. It cannot turn an unmailed letter into a mailed one.
Complete notice fileConnect the exact notice and enclosures to the recipients, addresses, receipts, and affidavit. Postal evidence alone generally does not establish what was inside the envelope.

USPS says customers can request a free manual local postmark at a retail counter. For a group mailing, ask USPS ahead of time about the appropriate service and firm mailing forms. Do not assume a self-service kiosk or printed postage date is equivalent.

A dependable board mailing workflow

  1. Identify the requirement. Record the event, deadline, authorized delivery methods, posting obligations, and required evidence. Have counsel resolve unclear calculations.
  2. Build in time. Prepare and send well before the last permissible day. Account for postal hours, holidays, processing, and any receipt requirement.
  3. Verify recipients and contents. Use the association’s proper address records and authorized electronic-consent records. Retain the final notice, agenda, attachments, and recipient list.
  4. Document actual acceptance. Use the required postal method and appropriate receipt or certificate. Request a local postmark when useful and check the date before leaving.
  5. Complete affidavits accurately. The person attesting should have a factual basis for what was done. Use counsel-approved wording and the proper execution procedure; never backdate.
  6. Preserve the complete record. File proof with the related notice. Retain returned mail, tracking and delivery records when relevant, and document follow-up.

A good mailing file makes compliance easier to explain.

Questions owners often ask

Does mailing my payment on the due date make it timely?

Do not assume so. Read the payment requirement and ask the association whether receipt is required. Allow delivery time or use an authorized payment method with confirmation.

Is a printed postage label enough?

The label date alone does not establish that USPS accepted the envelope that day. Obtain the evidence appropriate to your deadline.

Can the association just email everything?

Electronic transmission must be authorized for the particular communication and satisfy applicable consent and notice requirements. An email or website posting does not automatically replace required mailing.

Should I keep the envelope?

Yes, when timing may matter. Keep the envelope, contents, and a record of when you received them. Share the facts with counsel if a deadline is disputed.

This page was prompted by Mark Friedman’s “Postmarks,” published on page 11 of the May 2026 UCO Reporter. The article recommends stronger evidence for timely association mailings. The explanation above also incorporates USPS’s clarification that the new language did not itself change postmarking practices.

Keep a notice-by-notice evidence register

Board Synergy recommended practice

Use one record for each mailing batch. Connect the postal evidence to the actual notice and enclosures rather than keeping an unexplained receipt in an accounting folder.

A mailing vendor’s invoice shows a billed service, not necessarily that every correct enclosure reached USPS on the required date. Ask the vendor in advance what evidence it will provide and who will execute any required affidavit.

Two different election deadlines illustrate the risk.

Sending a notice and receiving a candidate submission are different events. A postmark alone does not establish timely receipt. Review the standard election timeline and have the administrator confirm the exact requirement.

If timing is disputed, preserve the original envelope, contents, receipt, tracking history, and dated account of receipt. Do not alter or recreate evidence to make the file appear complete.
